    Hi,

    I am a Settlement Agent/Conveyancer in Perth. There is not a lot of difference between the two aprt from a settlement agent cannot give legal advice. If the situation calls for legal advice we must hold the file and reuqest that the client seels legal advise urgently. Once the client has decided to seek that advice we then as conveyancers take instructions from the solicitor.

    As a Licensed Settlement Agent I had to attend TAFE for 3 years and complete 2 years prac before my license was issued. As for a solicitor they are able to apply for a license whenever they want as they are a solicitor. Even though they may not have any experience or training in the indusrty.

    So if you are in Perth I suggest that you employ a settlement agent as we have been trained in every aspect of the job and have been properly trained and screened by the Board.

    Hi,

    It depends on which state you are in. If you are in WA a unregistered POA (if over three months old) must be accompanied with a stat dec to state that the Donor is still alive and kicking. If you are in WA I can send you some info.

    Once the POA has been lodged with the Land Titles Office you are able to execute a contract of sale and all relating docs for that transaction. On the contract it must state the POA registration number. On the other settlement docs there is a special clause that is required to be completed.

    Check with your state Land Titles office for more info.

    Assuming that the rules are the same in each state the State Revenue Dept don’t care what you pay for the 50% share. A valuation must be completed by the VGO’s office which can take up to 4 weeks to be completed but if you are in Perth you can have a valuation carried out by a licensed valuer and if the val comes in less than $400K the SRD will stamp it over the counter. You will have to pay for example

    Property Val $400,000
    50% share $200,000
    Stamp duty due on the $200,000
    Due (perth s/duty payable) $6,200.00

    Hi Kylie,

    If you need settlements advice I would be happy to help as well. I run my own agency from home in the Northern Suburbs but service the whole of WA.

    I am also a PI and attended the first 07 WAPI meeting. It was fantasitc and very informative. Let me know if you want the details of the next meeting. You will learn a lot. I did!!!!!

    No I don’t that the moment. I have only just started from home this week. I need to get some sort of cash flow behind me first before i can start a website. I have enquired and they say approx $2500.00. EEEAAAAAKKKKKK.

    As for the short settlement time it is possible if the settlement conditions are right eg finance, discharge of mortgage, which banks are involved, where are the clients located etc The quickest settlememt i think i have ever completed was 2 days. That was interesting.

    Hi there,

    I have a success story from Perth. My husband and I had an agent to sell our house for 4 months. He brought us three contract 30000 under the asking price. Well you can only imagine what we told him to do with the offers. His commission was still to stay the same no matter what the final selling price was. So we decided to sell the house privately through Comfree. You pay under 800 for the use of their signs, advertising on the net, newspaper and a weekly booklet that’s disbirsed to the pubic. Within 2 weeks we had an offer 40,000 above what the agent had it for and with no commission. It is easy when i come to sell my investment I will use them again. Have a look in SA to see if they have anythimg like Confree here. Good Luck [exhappy]

    Thank you very much for the response. I can honestly say by being the industry for a long time that your comments are heard day in and day out not only by clients but by other members in the industry. The reason I left a larger company is so I was able to provide a more personal service to my clients. My beleif is that if I stay small (one woman band) then I have the time to communicate with my clients. I have found that in a larger office the clients are viewed as a number and placed on a McDonald’s assembly line and are not viewed as a person who has just made one of the biggest commitments and decisions of their lives. It is a very stressful time during contract signing and settlement and a number of agents out there seem to forget that.

    Once again thank you for your input and I will apply your comments to my professional approach with clients.

    Hi There,

    I am a settlement agent in Perth. Word over here is that the market is still in a boom. I think the prices are starting to become more realistic as the market has been flooded with homes. In the boom homes were in short supply and therefore pushed the prices up and people just bought everything without doing the homework. Now that the supply has increased the crazy demand and unrealistic housing prices seem to be going down to a more normal level. Buyers are now taking their time looking. Some houses are priced realistic in this current market and are been snapped up like hot cakes. If you take the time to look and do your homework on the property you will make the right buy for an investment.

    I have a Broker friend who, up until now has not been wrong (but remember there is always a first) regarding the interest rates and property appriciation. He thinks that the market will flatten and may drop in price but only slightly. The Perth market is still going strong according to a Settlement Agents point of view. The number of deals that are currently coming in are still the same as it was 6 months go. It will flatten out at some stage but I think (personally) that we may not see a drop in prices and / or a slow in the market for a while.

    Hi There,

    As per the last post I agree with him. I have tried to sell my house in Perth through an agent for four months. I thought that I was doing the right thing by employing the Principle/Licensee of the company but I was wrong. He had the sit back and do nothing approach. I did agree with his method so some extent as you don’t want the agent to be all over you while you are trying to make one of the biggest decisions of you life but then on the other hand he took it to far by sitting cross legged in front of my gas heater handing a information sheet to people as they walk through. In the end I ended the listing agreement and sold the property privately.

    Now I am a Real Estate Settlement Agent so I have to deal with the clients once you have sold the property. The way I deal with different clients is by assessing what type of person they are from the time I either meet them in person or talk to them over the phone. The only things that my clients want are the following:

    Information (lots of it)
    Listen to your clients (write notes) clients feel as though they can walk away from you knowing that you have taken their questions and them seriously
    Quick response to questions (same day)
    RESPECT.
