I am starting construction on a home and wish to get the FHOG.

I have never owned a home with the intent to live in it.

My problem is I have been part of a trust with two other partners, which completed a townhouse development.
    recently

The development was owned by the trust so I dont know if i can still get the grant.

I believe I should still get the grant as the development was purely an investment opportunity, no different than if the trust had bought shares instead of property.

Anyone know if I can get the grant?

From what you have outlined there is no reason why you wont qualify.

Get your mortgage broker to lodge the forms for you with the appointed agent and you should be fine.
Payment wont come through until the first draw is made on the construction.
