    Hi,

    I read something recently that mentioned that :

    “if you and your spouse are listed as the title holders of a property, depending on the State that the title is held, you may be able to transfer the title of the property into one spouses name without attracting stamp duty”.

    Can anyone point me in the right direction on where to find the law that stipulates this in each state.

    Hi – I know you cannot do this in NSW..tried it myself and confirmed via OSR.

    Can’t be done in WA either unless your spouse has died and the home was as joint owners (not tenants in common), then with the production of a death certificate they will transfer the name on the title to the living spouse.

    I am based in NSW to there goes that idea.

    Does anyone know if it possible to do this in QLD.

    You may be able to do it in NSW if you are getting a divorce and have a court order.
