    I have 45 acres in the hills above Perth and am wanting to subdivide it. I have a tentative plan compiled which seeks to maximise the number of 5 acre blocks I can get out of the block.

    In order to do this I will need to run the access road (off the main road) on the fenceline between my property and my neighbours property. I will of course have to pay for all the roads etc.

    My questions are: If my neighbour decides to spilt up his property in the future and some of his blocks will run off my access road, can I be compensated for the money I have initially invested in this road? I have been told that after two years the road becomes the property of the local council, will this affect my claim for compensation?
