    Car is in driveway of investment property. (not strata)
    Tree branch falls on car. Who is responsible?
    Tenants Car Insurance OR Landlord Home Insurance. If Landlord Home Insurance, this should be claimable as “what” in tax return.

    I would think car insurance. Best to ask the insurance company though.

    UPDATE – Now they want to claim through the Car Insurance but want landlord to pay the the excess. Sounds dodgey??

    Not dodgy, just trying it on.

    How did the tree fall over? Unless it was neglect on your part (eg the tennant had warned you it was dead or likely to fall over) I can’t see how you are responsible.
