    Looked at a house yesterday. Next door on the downhill side there is a brand new brick box of massive dimensions.

    Owner occupiers are living in it. looks like they have spent their last shekel on building it as there is nil turf, nil garden, nil driveway. Just an oversized home and a letterbox. All dirt.
    They have done a cut and fill leaving a drop of about 50 cm between them and the house we are considering. We are on the uphill side.
    They will need a retaining wall and a fence.
    Who pays? I think fences are 50 50 but what about retaining walls?
    They seem to be a bit short on folding stuff. I haven’t spoken to them yet but will if we get serious.
    Any answers from experienced retaining people on the forum?

    HI Giddo,

    Fences are usually paid for on a shared basis to a costing which is typical for the council concerned.

    Retaining walls will also come local government by-laws and thus the relevant council is your best source of information.

    You might find that because they have had to excavate as part of the building process that installing building retaining walls to maintain stable soil structure on neighbouring properties is part part of the council approval requirements. If this is the case then they should pay, but an agreement between you two can share this cost if this makes things easier and quicker for you
