    Jemm in Canberra again,

    For those who missed my earlier post, I am looking to move to Bris very soon, with my very limited 150k budget.

    I’ve found a lot of places in ok suburbs in my search for a place to live in Brissie, but NONE of the BC’s up there allow dogs!

    We are very attached to our cocker spaniel, and I refuse to get rid of the family pet just because we are moving.

    Is this standard in Brisbane to refuse pets in townhouses?

    HELP!!!!!!!!!!!!

    Hi Jemm,

    I wouldn’t have thought that EVERY single BC would be like that… bit of a pain if it is. I know that it is TOTALLY up to the body corp if you are renting, but i would have thought that it wouldn’t matter even you owned ? Perhaps you could try the REIQ and see if it’s a law up here… I’d like to hear back about that one too now!

    Hi Jemm,

    My wife and I live in a Brisbane City CBD apartment and our Body Corporate allows pets, as long as they are desexed and under 10 kilograms.

    So possibilities do exist! :)

    Gees, time to put the dog on a diet, or amputate a few limbs……LOL

    I’m flying up to Brissie on Feb 22 for a week to look for a place: if anyone knows of townhouses under 150k in “safe” areas where pets are allowed, PLEASE let me know here.

    Hi Jemm,

    Is it just one agent that’s telling you that?

    Basically, it’s up to the body corp, but they aren’t all like that. I’d just try another agency if it’s them telling you this.

    I’ve actually got the same response from over ten different agents listing more than ten townhouses – Murphy’s Law??

    Every place I have phoned about has given the same response, “No pets”.

    Hi Jemm,

    Our body corporate (Brisbane) doesn’t allow dogs. It is part of the bylaws.

    I think there are some townhouses on the southside of Bris, in and around Wishart that allow dogs.

    Hi From my understanding if you purchase the townhouse it is your property. The dog is just not allowed on the common areas so the minute you walk out side your door you have to carry them to the car or off the property. Check out your legal rights and if this applies in your state and you are not in breach of the body corporater re your unit and you keep the dog off the common areas i think you should be fine. It is ussally when you are renting that its a problem.

    Hi Gemm,

    As Derek stated, the Body Corporate and Queensland Management Act, 1977 states on page 191 under Bylaws:

    Keeping of animals
    11.(1) The occupier of a lot must not, without the body corporate’s
    written approval—
    (a) bring or keep an animal on the lot or the common property; or
    (b) permit an invitee to bring or keep an animal on the lot or the
    common property.
    (2) The occupier must obtain the body corporate’s written approval
    before bringing, or permitting an invitee to bring, an animal onto the lot or
    the common property.38
    38 However, section 143 of the Act provides as follows—
    Guide dogs
    143.(1) A person mentioned in the Guide Dogs Act 1972, section
    5, who is entitled to be on a lot included in a community titles scheme, or on the
    common property, is entitled to be accompanied by a guide dog while on the lot or
    common property.
    (2) Also, a person mentioned in subsection (1) who is the owner
    or occupier of a lot included in a community titles scheme is entitled to keep a
    guide dog on the lot.
    (3) A by-law cannot exclude or restrict a right given by this
    section.

    Hope that you can find a different type of housing to overcome this dilema.

    Thank you everyone so much for your help!

    Obviously I am a learner in this aspect of home-ownership. I have never owned a town-house, only actually houses.

    I’ll print a copy of that info and take it along when looking next week.

    Back to my new home searching!
