    My mate reckons he has been banned from a real estate agency last week. (Long story, but a property he purchased wasn't given back as a rental to the same agency….)

    He said the Director called him and told him not to bother calling to purchase another property ( so far he has purchased 3 with this agency)

    Is this legal? How would a vendor react if you find out someone is interested in your property but the agent won't accept his offer due to personal issues? I thought in Victoria an agent has a legal obligation to let the vendor know of any offers whether they are low or not?

    Is your mate a time waster? I guess an agent can decide not to deal with certain customers as long as it is not based on one of the categories of discrimination – sexual preference, religion, disability etc.

    Hi Terry,

    His certainly no time waster. He has purchased 3 properties from the same agent in under 2 years.  The agent some how thought there was some sort of deal where my mate purchases the property and the agent gets to manage the property. When the agent realised some one else is managing the property he hit the roof.

    Thats just wrong !!

    seems pretty unfair to me  and possibly illegal as well  in that respect

    That's what i think. I said to my mate just go straight to the vendor and deal with them direct.

    Just get someone else to sign as POA. The licensee has his head up in the clouds not.

    Sounds like the Agency Principal wanted the sale and the management.

    Interesting customer relationship skills – given RE is based on relationships this is not a good sign for this agency.

    Derek I agree with you. Funny enough this agency has been in the spot light many years ago for dodgy dealings. The exact words the agent said was “we let you purchase this property at below market value, we should have the right to manage the property. Bit cocky I thought.

    Err no – the vendor accepted the price.

    If this comment is a 100% reflection on what happened then this agent/agency did not comply with their fiduciary responsibilities to the vendor.

    Maybe things are 'tight' in the office and every cent counts. No excuse though

    MMM – I have been an investor, developer and also own 2 agencies as a principal.

    Hard to say what the case is here- I have asked in the past a few people to leave my offices and as an owner you do have the right to pick and choose who is in your premises. The only reason I would ever ask a customer to leave would be the following-

    – Rude, abusive, swearing, screaming

    – Sexual suggestions to my female staff

    – Unreasonable and extremely difficult to deal with

    From the other side of the coin as an agency owner I can tell you I have had people in that have spoken to me like a slave, sworn, yelled, cried, screamed and threw things when their offers did not get accepted by the sellers, got upset when their property has been vacant for a few weeks if the rental market is slow, or they are not getting the price that they wish for in the market. Had people tell me what to do, how, why and when and speak down to me and not listen to any advice or the market conditions.

    Running an agency sometimes you nearly need a degree as a counsellor as we see financial pressure, stress, bankruptcy, divorce, separation, fights over estates, people that lost a lot in superannuation/ shares switching to property and wanting property to fix all their financial pressures in a very short time, and getting very upset if it doesnt. We also see a lot of people getting ripped off at seminars and then getting very upset when the property does not sell or rent for what they have been told.

    Your friend must have done something to upset the principal?? maybe as often it doesn't worry a principal if a different managing agent, especially if 3 houses have been bought.

    So probably need to look a bit deeper here what has happened or been said ?

    If you were to meet my mate you would understand. Quite guy, you would be lucky to get a sound out of him. That's why when he told me i didn't believe him at first. Some how the agent just thought he automatically gets to manage the house.

    I understand what you mean about people being demanding and rude. I get it all the time.

    Hi Joe,

    I used to work as a real estate and one thing that helped me grow my business was after service.

    Is it illegal for the agent not wanting to work with your friend? Not all, Only if it is based on race, “etc” like Terry suggested.

    What should your mate do? Is don’t worry about the agent and move on, there are plenty of other agents who want business

    Should your mate go to the vendor directly? Do not risk it, if you are saying this agent is dodgy. Why if your friend does a deal with the vendor the agent (especially if he is dodgy) can sue the vendor for commission.

    A agent should present any offer the vendor, if the agent was smart it would help him condition the vendor!!!

    I remember there was a buyer who called our office on a Monday at 10:00 to see a house that was on the market for 1 year. No one wanted to show him the house because they thought he was another time waster, I took the call.

    Moral of the story, I end up selling him over 10 properties in one year and sold 5 and we have been mates for a couple of years now.

    The agent   sounds like an agent who would do well” in good time” but fail in hard times.,

    Dont waste time tell your mate not to worry about it.

    My mate is not overly concerned, but i agree with Johanns comments. When hard times sets in he will find it difficult.

    I could understand getting banned for being rude or violent, but this is petty.

    I have been involved in a similar thing, not banned but when I chose NOT to use the sales agent as the property manager they refused to deal with my buyers agent anymore. My buyers agents does massive deals and he did nothing wrong, and honestly neither did I as I never met them and only spoke to the sales agent once. They were desperate to keep managing the property offering ridiculous promises, obviously not a good agency.

    An agent can refuse to deal with a buyer if he/she has exclusive rights to manage the sale, it may not be ethical but it is legal. I suspect your friend may have previously enlisted the help of this particular agency to scour for suitable properties for him specifically to buy and then when the loyalty card was not returned the Principal became angry?. A few older school style agents would cross the road rather than say hello to someone who did not list a property with them and who had previously had dealings with them. After all- real estate people are a highly competitive breed, they need to be to succeed. This agent's demand for loyalty stems from days of old when agents relied on loyal clients for their income ie pre internet days, when they took you around in their car to show properties. The commodity was people versus today where property is viewed as product and agents move product. They  have moved away from  personalised relationships with clients, (as has your bank manager largely).  due to technology, automation and the decentralised nature of modern human contact.
