    You do not have to use a solicitor to make a will. But if you do something wrong – eg getting a beneficiary to witness it, it could end up being uselless.

    check out http://www.lawcentral.com.au for some wills you can purchase on line. also look up testamentary trusts.

    Yes I agree with Simon, just pay cash or using a credit card would be better than a loan. Commerical loans usually have high application fees and high valuation fees – $1000+.

    It would be very hard to use a managed fund as security, but you migh be able to use a term deposit as security for a housing loan. But in the end, this would be just like putting down the cash for the loan which would be a lot easier and cheaper.

    There are also a few lendersout there lending 100% of the pruchase price.

    You can avoid paying the stamp duty if you don’t sign the contract, you just collect money as a finder’s fee. But of course, you run the risk of the new pruchaser bypassing you and going direct.

    Hi Mike. Stamp duty makes these sorts of deals tough as it eats a lot of the profit.

    If it is a divorce settlement, then the person may be able to get a loan based on valuation rather than the price they are paying for their share. But, they may still need to show income to services.

    If I could start again, I would not go to university, but start work asap – maybe in a buidling trade, or finance. And then go and buy as many properties as fast as possible. High growth ones, not cashflow.

    For deposit bonds, you pay the fee up front, depending on the lenght of the bond and the amount etc.

    Loan approvals generally only last for 3 months, so you may have to apply again or supply updated payslips at least.

    Fixed Rates are usually always the rate at settlement. These days a number of banks are allowing customers to ‘lock in’ their rate at application or soon after. But they are charging a fee of around 0.15% of the loan amount. These lock ins also only last for 3 months.

    You can use your equity by obtaining a LOC on your Australian properties and then using this money as deposits for your NZ property.

    There will be possibly exit fees, deferred establishment fees and fixed break cost fees to exit. If fixed rates have fallen, then you could be up for huge costs to exit a fixed loan.

    eg I had a $80,000 loan, fixed, sold the property and paid nearly $4000 in break costs!

    Then there will be new fees for the new loan, application fees etc. and a few small fees such as Title searches etc, maybe even LMI again if you go over 80% LVR. If you increase the loan size, you may have to pay stamp duty on the increase portion as well.

    I would just ring up your lender and ask for a estimate of the exit fees if you paid out the loan today.

    This would only work if the seller had clear title to the property, ie no loan, owning it outright. Otherwise the vendor could not transfer title without paying out their existing loan.

    So I would think this situation would be rare, but possible.

    Another way to do it, would be to get a loan, and then lease the property to a tenant and sell them an option to purchase as well. The title would stay in the seller’s name. This is legal, and I have done 3 of these in Victoria myself.

    Section 118-145 of the Income Tax Assessment Act allows the main residence CGT exemption while the taxpayer is temporarily abscent for up to 6 years.

    Also go down to your local court. There are various brochures available regarding debt collection. You also may be able to find collection agencies that are willing to collect your debt for a percentage – 10 to 20% depending on the size.

    Usually if you do not settle on the required date, they will give you a few days, and then issue you a formal notice to complete giving you 14 days in which to settle. So you have some time up your sleeve there.

    Q. What is the best loan structure for investing?
    A. It depends, probably IO would be better for investments, with each loan stand alone (ie not cross securitised)

    Q. Should I have all my loans at one bank? (Mates rates?)
    A. Sometimes you can squeeze discounts out of a bank if you have leverage. But then again, having all you eggs in one basket can cause problems when this bank says you cannot borrow any more.

    Q. How soon should I get an accountant involved?
    A. You should probably get an account involved from the beginning.

    Q. Whats different about a trust account?(Is that a blonde question)
    A trust will save you tax, and help wtih asset protection.

    Q. Whats the quickest way to be able to get together deposit for IP’s to avoid morgage insurance?
    A. Save like mad, wait for values to increase and access the equity.

    Q. What is the CG tax rate?
    A. There is no rate for CG. Usually half the gain, less costs is added to your other income.

    Q. When does it apply? And what conditions are there?
    A. When you sell an asset, if held, more than 12 months, then only half the gain is assessed.

    Q. Is this too much?
    A. No.

    The best way to do renos is to get a LOC on other properties, so you can pay cash for these properties, do them up and sell them – avoiding high discharge fees.

    Hi Kevin

    This sounds like a lot of trouble to save a few dollars per week. Sometimes ahving an agent is good to put some distance between landlord and tenant. eg. it is hard to tell someone that their rent is going up, but much easier to do if you go thru an agent. So you could be ‘squeezing’ out a few more dollars if you actually used an agent.
