if the domain is emex.com.au ( which I assume it is ) then you have no problems in keeping the domain. That name is used all over the place, it can't be registered as a global trademark. I have also predicted that banks will be limited ( by law ) in mortgaging people. I think the law will be amended to 4 times your raw yearly income.
