    Hi mortgage Adviser,

    If I had enough cash to stay out of mortgage lender territory, then wouldn’t it be pointless to ask the vendor to leave 20% in the deal? I may as well use the cash as a deposit.

    You could try lavender oil mixed in warm water. It seems to get through anything, in particular those horrible little stickers you get on crystal glasses and things.

    I should have read ‘Steady’s’ topic before posting this one.

    What if it’s in a depressed market where the property will possibly go down in value?

    What if interest rates are on the rise?

    Wilandel, pardon my ignorance, but if this was the case, what would happen to your loans that had equity redrawn from them?

    Hi Anne,

    Now that I have calmed down……..I gave the property the flick today and will be collecting the deposit on Saturday.

    Apparently the vendor has heard how well this town is doing and wanted to up the ante, hence the change in price.

    Hi Derek,

    That’s a BIG negative on the fallen in love with the property scenario. I don’t particularly care about the house, we have others that we are currently looking at anyway.

    What I do care about are agents with poor and inadequete communication who are to gutless to tell the situation to my face, but do what they want to do in an underhanded manner. In my book that’s totally disrespectful and very poor business sense…that’s what the issue I have is. Was I supposed to read this guy’s mind that he had put it back on the market?? It was only purley by chance that I discovered that it had been listed again.

    Up until the moment that both of you sign the contract and agree to all conditions anyone can buy it. I wouldn’t hand over my deposit until this point in time.

    For someone to do this, the agent would have to tell them the price you offered wouldn’t they?

    Anyway…..that’s my vent for the evening [chill]

    And another thing, what’s the point behind putting a deposit down if someone can come along and take the house from under your nose?

    Hi Surrey,

    Until that contract is signed and witnessed by both you and the vendor a price has not been agreed on and no obligation to sell or buy has been created. (though it is a bit rude)

    Damn right it’s rude. As far as I am aware, no one has offered a higher price, otherwise it wouldn’t be advertised on the website for 210 000 right?

    I was told in another post I made that the seller and agent agree on a price that suits both of them before putting it on the market. If that’s the case, then obviously they have been in cahoots with each other and decided to ‘can’ our negotiation and put it back on the market at a higher price.

    A contract had been signed by both parties, but we were negotiating on price – obviously both parties signing a contract while negotiating means nothing.

    Pretty annoying. Yhanks anyway,

    Hi again Derek,

    I see where you are coming from and agree with what you are saying, but I should clarify the situation. On reading back on what I said originally, I forgot to mention that we actually had a contract for $175 which we had signed. You may be thinking well if that’s the case what’s the problem?

    Well the way the agents work in this particular town is that they want you to sign the contract first to show the vendor that you are serious and entice the vendor to sign [eh]. Sounds dodgy, but this is the way all the agents we have spoken to do it in this town. It’s a bit back to front and had us in a bit of a tail spin when we bought our first house here but it worked out. The agents seem to push the 5 day cooling off period to put buyers at ease.

    We made sure that we had all the special conditions in the contract that our solicitor recommended from our first contract, before signing this one. The agent didn’t tell us about the ‘issues’ until we followed up 2 weeks later as to what was happening as there had been no word, and to be honest we didn’t even think of adding a clause to the contract about issue resolution.

    Personnally I don’t like doing it this way and would rather negotiate a price before signing anything, but as I said before we are still learning the in’s and out’s of investing.

    The more I write about this the worse it sounds! Anyway, look forward to your reply…..I’m sure you will have plenty to say.

    Hi Jenny1,

    Our second property that we are currently in negotiations for has the same type of stuff by the sound of it. It makes the house very dark and feel quite small.

    We have had advice from a paint shop that you can just paint over it with the right kind of paint (I don’t know what sort). Firstly you need to paint between the joins with a brush and then go over the rest with a roller.

    Thanks for that. In our defence however, I don’t think that we are letting ourselves down. This is only our second investment property and are still learning right from wrong. We are maintaining our original offer of $175 000, the only thing we have changed is the settlement time.

    The price is determined by a vendor and buyer agreeing on a price that suits both parties. It is not determined by one party or the other.

    This is what I wanted to know. Thankyou, at least I know where we stand now.

    My suggestion would be log out totally, thus freeing up the “username” being inaccessible. Then, when you log in, when it gets to the box that asks whether you wish to move onto ACTIVE TOPICS or YOUR PROFILE etc, select your profile, and try it from that point.

    Tried this also Jo….No luck. I’m at a loss!![hmmm]

    When you going into your PROFILE do you see the AVATAR box??? Yes.

    Have you selected one, that is highlighted one (make sure it previews in the box) Did that.
    , then when all this checks ok, go down the the SUBMIT button and click to save it. Did it.

    Failing that, don’t know what you could be doing wrong.

    Don’t see what else I could be doing wrong [blink].

    It still keeps telling me that my username is already in use/exists. Never mind.
