    Hi Terry,

    Thanks very much for the quick response on this!

    on 1) I assume this would be spelled out in the loan contract? How would a bank typically respond to having the only two guarantors of a loan change from being residents to non-residents – I expect they may want a third Australian resident guarantor to be added in this case?

    on 2) I assume this would apply for all 4 IPs (i.e. the three for my wife and the one for our trust/company)? If so, would be any benefit from transferring the fourth IP from our trust to my wife (as a beneficiary of the trust) and then selling the remaining securities and wrapping up the trust/company structure? This would leave all assets in our personal names and remove the complexity of the trust/company structure.

    on 3) I’ve been reading a few of these cases too to try to understand the ATO’s interpretation of ‘non-resident’ (which tends to surround whether or not a ‘permanent place of abode’ has been established from my read). Would it be best to seek a private ruling from the ATO on this? If so, do you know what a likely turn around time may be?

    I’ll definitely be seeking advice, so I’m keen to get my head around all of the potential issues and do some of my own research in preparation for this.

    Hi Terry,

    How does one go about submitting a variation such that less tax is paid each week (rather than waiting until year end to claim it all back in the tax return)?

    I assume there is a certain type of form to fill in?

    Hi Richard,

    With the instalment contract, would the date of sale be the date of the first instalment payment or the last instalment payment? And is this the same date used to calculate the CGT payable (and if this date falls after my friend’s father in law retires will he effectively pay less tax on the sale?)

    Do you know if clear docs (or any other online legal document generator) would likely have a pre-written instalment contact or put/call option? I can’t seem to find one but perhaps you know of one?

    If not. then how much do you think a lawyer would charge to draft up a water-tight one that my friend could use?

    As an update guys,

    There are now over 50 people on the mailing list, and our first two meetings both had in excess of 15 attendees.

    With consistent attendance like this, I’m sure all of our future meetings will be successful.

    I’m trying to get a good theme going for the next catch up, so if you have any thoughts please email them through.

    Once again if you’re keen to join the group, or if you’re already a member and you wish to assist in running the group meetings (which at 50 members is starting to almost become enough for one person) please let me know at *removed*

    Hey D,

    Haven’t seen anything in that market (yet) that makes me want to get into it… But I may have to go over with work later in the year, so I thought I’d ask around and see if it were even possible so that whilst I was over there I could keep an eye out and talk to the right people.

    Also might be heading to Canada, and their market looks much more affordable than here (for good reason though!)

    Hi Everyone,

    Just an update to say thanks for attending our first Investor Catch up tonight!

    The night went very well (and late), and I think it’s safe to say that everyone had a great time meeting new people and sharing their ideas on investing. It was also a great opportunity to put faces to names, and to hopefully build long lasting networks.

    I’d like to re-open this discussion to all those who attended to give their feedback on the night, and suggest additions that we can incorporate for the second session (which will take place anywhere from 2-4 weeks time)

    It would also be great to hear from those who didn’t make it tonight, or those who are reading this post for the first time.

    I look forward to everyone’s feedback, and I look forward to catching up with you all again very soon!

    I won’t list everyone’s name here, but I’ve had over 20 people email me wanting to come along… I would expect 40-50% of these people will show up in any given month?? We’ll see on Thursday night.

    Hi Terry,

    Thanks very much for the advice!

    So am I correct in thinking that if I set up a corporate trustee, that I should be the sole director and shareholder, and that this company should definitely do no trading?

    And once this company is setup I should ‘hold a meeting’ in which I (as appointer) add my company as a trustee to our trust, and also resign as trustee myself (and my wife also). This will leave the old and new trust structures looking as follows:

    OLD STRUCTURE
    Trustees: me and wife (both named in full)
    Appointer: me
    Beneficiries: me and wife (both named in full)

    ACTIONS:
    me: set up new company with me as director and me as shareholder (no mention of wife anywhere)
    appointer (me): adds company as trustee
    me: resign as trustee
    wife: resign as trustee
    all of this noted as a minute and stored within the trust documentation

    NEW STRUCTURE
    Trustees: New company
    Appointer: me
    Beneficiaries: me and wife (both named in full)

    Also you mention to watch out for naming beneficiaries within the deed. As both my wife and myself are named by our full names, will this present any problems?

    Finally, do you really think it’s worth starting over, or will a simple minute as detailed above achieve most of what I want? I currently have no assets within the trust (only a bank account and a comsec account).

    Ok guys and girls, almost there!

    Hi Everyone.

    Making some real progress here!

    I have email addresses from 6 of you already, and it looks like the only days people are not free are Friday/Saturday/Sunday (as expected) and the occasional Monday and Wednesday on alternate weeks which we can easily work around.

    It also looks like the discussions will end up taking place in (or near) the city, location to be confirmed, after 7.30pm. Again, I can arrange a carpool if people need.

    …or it’s possible that you have emailed me, but I haven’t been able to match your email address to your PI.com username. If this is the case, please send me a second email stating your PI.com username so that I can match it to your email address and confirm numbers.

    Once the ‘master list’ is compiled, I will send everyone an email as a test (I’ll do this later next week). If you don’t receive this test email by Friday 15th Jan, please let me know on this forum, or email me at *removed* letting me know.

    We’ll push hard to have the first catch up in either the last week of Jan, or the first week of Feb. Looking forward to it!

    Hi everyone.

    Sounds like there is a fair bit of interest! This should be an exciting group to get together and discuss investing.

    These catch ups will give us all a great opportunity to network and to learn more collectively. The intention is that there will be NO SELLING, and the members of the discussion will enforce this intention during catch ups.

    I’ve had emails from a few of you, but not everyone. If everyone is able to email me, then I will compile an email list so that I know all of you are receiving my communications (and not having to check this forum every day etc).

    In your email, can you please note which days you will NOT BE FREE. This is easier to try and schedule a night where the majority of people are free.

    Finally, as we have a few westies it may end up being easier for all if we meet in the CBD. This may also prove easier if the group expands over time such that we can accommodate everyone. Please indicate in your emails if you WILL NOT be able to get to the CBD in the evenings. If it’s easier for anyone, I may be able to organise a carpool from CBD to the east (forest hill or there abouts…)
